Michael Jeffrey Jordan, introducing himself formally in a federal courtroom on Friday, admitted that his competitive side and novelty within the sport motivated his push for 23XI Racing to confront Nascar over perceived violations of competition laws.
Financial Stakes and a Will to Win
Jordan shared operational insights of his 23XI team, saying he invested $40 million of his own funds into the Cup Series operation co-founded with business partner Curtis Polk and driver Hamlin.
“Someone had to step forward,” Jordan stated in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I felt I could challenge Nascar as a whole. I felt as far as the sport required examination through a new lens.”
Central Issue: Charter Agreements and Contract Pressure
The heart of the case involves the expiration of a 2016 deal where Nascar provided each team a “charter”. The concept is similar to other professional sports with independent franchises, like the Charlotte Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar demanded teams renew their charters.

Spearheading the Fight

Heather Gibbs detailed her push for indefinite franchises, which she said a formal letter to Nascar. She testified the timing of the contract signing demand was problematic.
She said, Joe Gibbs first attempted to call and talk Nascar out of demanding signatures, but Nascar’s leader declined the request.
“Please don’t force this on us,” Heather Gibbs said Joe Gibbs told Nascar’s executives. The response was, “If I wake up and I have 20 charters, I have 20. If I have 30, I have 30.”
